1. What You Are Buying (The License)

When you purchase a TerraViz3D package, you are not buying the underlying 3D software or the raw geographical data. You are purchasing a single, non-exclusive, non-transferable license to use The Scene (our interactive 3D property link) and, if included in your tier, The Media Kit (rendered video assets) to market a specific real estate property.

2. Your Responsibilities

You represent and warrant that you are the authorized real estate agent, broker, or owner of the property you are rendering. You may not use TerraViz3D to generate content for properties you do not have the legal right to market.

3. Third-Party Data Disclaimer

TerraViz3D utilizes high-fidelity geospatial data from third-party providers, including Google Earth and Cesium Ion. We do not own or control this data. The 3D environment is reconstructed from satellite and aerial imagery that may not reflect recent changes to the property or its surroundings (e.g., new construction, demolished structures, seasonal landscaping). TerraViz3D is not responsible for outdated, incomplete, or inaccurate base data provided by these third-party sources. The Scene is an artistic marketing representation, not a legal land survey.

4. Hosting of The Scene

If your package includes The Scene (a hosted interactive 3D link), TerraViz3D agrees to host this link for a minimum of 6 months. We reserve the right to archive or delete inactive links after this period to maintain server performance.

5. Limitation of Liability

TerraViz3D creates marketing assets. We do not guarantee that The Scene or The Media Kit will sell your house, win you a listing, or make you go viral on TikTok. In no event shall TerraViz3D be liable for any lost profits or indirect damages arising from the use of our services.
